Meta Platforms has denied the allegations made by a group of 29 U.S. states that it purposely aimed to make children dependent on its Facebook and Instagram platforms for financial gain as a significant trial began on Tuesday. The states, representing both sides of the political spectrum, are suing Meta, seeking substantial financial penalties and changes in the company’s practices.
California, Colorado, Kentucky, and New Jersey are leading the charge against Meta, accusing the tech giant of designing Facebook and Instagram to engage young users in ways that promote negative mental health outcomes, including anxiety, depression, and even suicide. The states assert that Meta misled consumers about the safety of its platforms and violated federal laws by improperly handling children’s personal data.
The trial, taking place in an Oakland federal court, is considered a pivotal legal examination of the impact of social media on young users. Meta, along with other major social media companies like Snap, TikTok’s parent company ByteDance, and YouTube’s parent company Alphabet, face numerous legal challenges regarding the potential harm caused to young users by their platforms.
During the trial’s opening statements, Megan O’Neill, a deputy attorney general for California, accused Meta of prioritizing user engagement, data collection, and concealing the truth from the public, especially concerning children. O’Neill emphasized that Meta’s strategies were particularly effective in attracting young users and assuring concerned individuals about their safety.
In response, Meta’s lawyer, Paul Schmidt, acknowledged the challenges faced by some social media users but pointed out that research has not definitively linked adolescents’ social media use to diminished well-being. Schmidt highlighted Meta’s commitment, led by CEO Mark Zuckerberg, to enhancing the platform’s services rather than endangering users.
The trial proceedings are expected to last approximately six weeks, with the jury providing an advisory verdict that could influence the final ruling by U.S. District Judge Yvonne Gonzalez Rogers. Should Meta be found liable, civil penalties and modifications to Facebook and Instagram may be imposed, potentially amounting to significant financial consequences for the company.
Furthermore, the states involved in the lawsuit are pushing for extensive changes to Facebook and Instagram, including the removal of features like likes and infinite scrolling, the implementation of time limits for younger users, and stricter regulations to prevent children under 13 from using the platforms.
As the trial progresses, testimonies from key witnesses, such as former Meta safety engineer Arturo Bejar, are anticipated. Bejar has criticized Meta’s approach to child safety measures and highlighted the company’s lack of consideration for safety in deploying new features like Reels short-form videos. The trial is also expected to feature testimonies from top Meta executives, including Mark Zuckerberg and Adam Mosseri, the head of Instagram.
Outside the courtroom, critics of Meta have voiced concerns, with some sharing personal stories of tragic incidents allegedly linked to social media use.
